On October 21, 2020, the California Supreme Court in the Pico Neighborhood Association v. City of Santa Monica case unanimously granted a review of the Court of Appeal decision which had favored the City. The Supreme Court ordered the Court of Appeal opinion depublished.
This means the opinion may not be used as a legal precedent. The Supreme Court ordered the parties to brief the following issue: What must a plaintiff prove in order to establish vote dilution under the California Voting Rights Act? No schedule for briefs or oral argument has been set.
